What we noticed
What the score does and doesn’t do
The checker compares spelling, sound (with rules for Indian names, so Kavach and Kawach sound alike), shared words and classes. It doesn’t weigh meaning, logos, the goods themselves or how buyers shop, and it doesn’t apply the legal test that the Registry or a court would. Treat a high score as a reason to look closer, nothing more.
The legal test, for context
Indian courts ask whether an average buyer of ordinary intelligence and imperfect recollection is likely to be deceived or confused. The marks are compared as a whole (look, sound and idea), not side by side or syllable by syllable. Courts also weigh how similar the goods are, who buys them, how they are bought and other circumstances. Medicines get a stricter test.
The Supreme Court held Gluvita deceptively similar to Glucovita, and this checker also rates that pair High. It also held Lakshmandhara deceptively similar to Amritdhara, judging the overall impression the names leave on a buyer with imperfect recollection. This checker rates that pair Low, because it compares letters and sounds and can’t weigh an overall impression. That gap is why a score is a starting point, not an answer.
