A registered trademark in India is valid for 10 years from the date of application and can be renewed for 10 years at a time, as many times as you like. File Form TM-R up to one year before expiry; the official fee is ₹9,000 per class online. If you miss the date, you get six months after expiry to renew with a surcharge, and until one year after expiry to apply for restoration.
How long is a trademark valid in India?
Ten years. Your registration is dated from the day you applied (Section 23(1) of the Trade Marks Act, 1999), and it lasts ten years (Section 25(1)). Each renewal adds another ten years, counted from the date the previous registration expires (Section 25(2)).
So a mark applied for on 15 March 2017 expires in March 2027, ten years from the application date, even if the registration certificate only arrived in 2019. IP India's application status page shows the current validity date for your application number.
Our trademark renewal date calculator estimates the expiry date, when renewal opens and the late-fee deadlines from your application date. Confirm them on IP India's status page before you rely on them.
When can you renew a trademark?
| When | What you can do | Where it comes from |
|---|---|---|
| Up to 1 year before expiry | Renewal opens; file Form TM-R | Rule 57(1) |
| In the 6 months before expiry | If no renewal is filed, the Registry sends a reminder notice (Form RG-3) to the registered proprietor | Rule 58(1) |
| On or before the expiry date | Renew at the normal fee | Section 25 |
| Up to 6 months after expiry | Renew with a surcharge on Form TM-R; the mark is not removed | Section 25(3), Rule 59 |
| After 6 months | The Registrar may remove the mark and advertise the removal in the journal | Rule 59 |
| After 6 months, up to 1 year after expiry | Apply for restoration and renewal on Form TM-R; the Registrar decides, considering the interests of others | Section 25(4), Rule 60 |
Here is how that plays out for a mark applied for in March 2017:
- March 2026: renewal window opens
- March 2027: registration expires (ten years from the application date)
- Until September 2027: late renewal with surcharge
- Until March 2028: restoration and renewal, at the Registrar's discretion
These months are estimates for illustration; your exact dates are in the Registry's records.
Don't wait for the RG-3 notice. Not receiving it doesn't change your expiry date, and if your address or email has changed since you filed, it may never reach you.
What is the trademark renewal fee in India?
| Situation | Online (per class) | Paper (per class) |
|---|---|---|
| On-time renewal | ₹9,000 | ₹10,000 |
| Late renewal within 6 months (renewal + surcharge) | ₹9,000 + ₹4,500 = ₹13,500 | ₹10,000 + ₹5,000 = ₹15,000 |
| Restoration and renewal within 1 year | ₹9,000 + ₹9,000 = ₹18,000 | ₹10,000 + ₹10,000 = ₹20,000 |
These figures come from the First Schedule to the Trade Marks Rules, 2017, as listed on IP India's forms and fees page. Check the current fee on IP India's website before you pay. Unlike the application fee, the renewal fee has no lower rate for individuals or small businesses. If you use an agent, their professional fee is extra.
The fee is charged for each class. A mark registered in three classes costs three times as much to renew, so budget for it.
How to renew a trademark online: step by step
- Find your details. Note the application or registration number, the classes and the validity date from IP India's status page.
- Check the owner details. Renewal is filed by the registered proprietor or their agent. If the business has changed hands, or the owner's name or address has changed, get the register updated as well; your agent will know the right form.
- File Form TM-R on IP India's e-filing portal, or through a registered trademark agent.
- Pay the fee for every class you are renewing, and save the receipt.
- Track the status until the register shows the new validity date.
Tip: renewing early costs you nothing in time. The new ten-year term runs from the old expiry date (Section 25(2)), not from the day you file.
My trademark has already expired. What now?
- Within six months of expiry: file Form TM-R with the surcharge. Under Rule 59, the mark is not removed if you apply within this period.
- Between six months and one year after expiry: the mark may already have been removed and the removal advertised in the journal. You can apply for restoration and renewal on Form TM-R (Rule 60). The Registrar considers whether restoring it is fair to others who may have relied on the removal.
- More than one year after expiry: the restoration window in Rule 60 has closed. Courts have sometimes ordered restoration later, for example where the Registry removed a mark without sending the renewal notice, but others have refused after long delays. That is a court matter, not a filing, so speak to a trademark attorney, agent or advocate. Often the practical route is a fresh application, which has to go through examination and the journal again.
During any gap, someone else could apply for a similar mark. Keep an eye on the Trade Marks Journal, or set up a trademark watch.
Can a renewed trademark still be lost?
Yes, for other reasons. The most common is non-use: a registered mark can be removed if it has not been genuinely used for a continuous period of five years after it was entered on the register, counted up to three months before the application to remove it (Section 47). Keep using your mark, keep dated proof of that use, and file for new classes if you expand into new products.
A registered mark also doesn't stop copycats from applying. If someone files a similar mark, you still need to oppose it within four months of its publication; see how to oppose a trademark in India.

Keep your renewal date in view
Put your expiry date in your calendar today, with the reminders from the checklist above. Between renewals, a BrandKavach watch emails you when a look-alike or sound-alike mark appears in a new journal issue, so you can oppose it in time. See pricing or start a watch.

Frequently asked questions
How long is a trademark valid in India?
Ten years from the date of application, under Sections 23 and 25 of the Trade Marks Act, 1999. It can be renewed for ten years at a time, without limit.
When can I apply for trademark renewal?
Up to one year before the registration expires, by filing Form TM-R under Rule 57 of the Trade Marks Rules, 2017. Filing early doesn't shorten your term, because the new ten years run from the old expiry date.
What is the trademark renewal fee in India?
The official fee is ₹9,000 per class for online filing and ₹10,000 per class on paper, as per the First Schedule to the Trade Marks Rules, 2017. Check the current fee on IP India's website.
Can I renew my trademark after it expires?
Yes, within six months of expiry by paying a surcharge. Between six months and one year after expiry, you can apply for restoration and renewal, which the Registrar may allow. After that, you will usually need professional advice and possibly a fresh application.
Will IP India remind me before my trademark expires?
If no renewal has been filed, Rule 58 provides for a notice in Form RG-3 to the registered proprietor, sent not more than six months before expiry. Not receiving it does not change your expiry date, so keep your own reminders.
